Welcome to Easy Web Studios, LLC ("Company," "we," "us," or "our"). By using our subscription-based SaaS services and SMS communications, you ("User," "Customer") agree to the following Terms and Conditions.
Please read them carefully before accessing or using our services.
1. Acceptance of Terms
By signing up for our services and providing your mobile phone number for SMS notifications, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, do not use our services.
2. Subscription and Billing
A. Subscription Plans
We offer various subscription plans, each with different features and pricing. Plan details are available on our website.
B. Free Trial
If your subscription includes a free trial, you will not be charged during the trial period. Once the trial expires, your payment method on file will be automatically charged for the selected plan unless canceled before the trial ends.
C. Automatic Renewal
Subscriptions automatically renew at the end of each billing cycle (monthly or annually, depending on your plan). The payment method on file will be charged unless you cancel before the renewal date. By subscribing, you authorize us to charge your card for each renewal period until canceled.
D. No Refund Policy
You can cancel your subscription at any time, but no refunds or credits will be provided for the current billing cycle. Access to the service remains active until the end of the paid period. Partial months or unused portions of the service will not be refunded.
E. Payment Processing
Payments are processed via third-party payment providers. If a payment fails, your access may be suspended until the issue is resolved. You are responsible for keeping your payment details up to date.
3. SMS Communication Services
A. SMS Service Description
We offer SMS notification services for appointment confirmations, reminders, and meeting information. These services are part of our appointment scheduling platform and are designed to improve customer communication and reduce missed appointments.
B. Consent and Opt-In
By providing your mobile phone number and checking the consent box during the booking process, you expressly consent to receive text messages from Easy Web Studios LLC. This consent is not required to purchase our services, but is necessary to receive SMS notifications.
C. Types of SMS Messages
You may receive the following types of messages:
Appointment confirmation messages
Meeting reminder notifications (typically 24 hours and 1 hour before scheduled time)
Zoom meeting details including meeting links, IDs, and passwords
Appointment change or cancellation notifications
Service-related updates regarding your scheduled appointments
D. Message Frequency
Message frequency varies based on your booking activity. You may receive approximately 1-3 messages per appointment. We do not send promotional or marketing messages via SMS.
E. Message and Data Rates
Standard message and data rates may apply according to your mobile carrier plan. Contact your wireless carrier for information about your messaging plan and rates.
F. Opt-Out Procedures
You may opt out of SMS communications at any time by:
Replying STOP to any text message
Replying HELP for customer support information
Emailing us at [email protected]
Updating your preferences in your account settings
When you opt out, you will receive a confirmation message, and no further SMS messages will be sent to your number.
G. SMS Service Provider
SMS messages are delivered through third-party SMS service providers. We select providers that maintain industry-standard security and compliance practices.
4. Account and User Responsibilities
You must provide accurate and complete account information, including a valid mobile phone number for SMS services. You are responsible for maintaining the confidentiality of your login credentials. Any activity under your account is your responsibility. You must promptly update us if your mobile phone number changes.
5. Service Availability and Modifications
We strive to provide uninterrupted access but do not guarantee 100% uptime for our platform or SMS delivery services. SMS delivery may be affected by carrier networks, device compatibility, and other factors beyond our control. We reserve the right to modify, suspend, or discontinue any part of our services, including SMS features, at any time. We may update pricing or plan features, with prior notice sent to users.
6. Cancellation and Termination
You may cancel your subscription anytime through your account settings. SMS services will automatically terminate when your subscription ends. Once canceled, you will not be charged in the next billing cycle, and SMS services will cease at the end of your current billing period. If we terminate your account due to a violation of these Terms, no refunds will be provided.
7. Prohibited Activities
You agree not to:
Misuse our services for illegal or unauthorized activities
Attempt to reverse-engineer, copy, or distribute our software
Use our services to harm or harass others
Provide false phone numbers or consent information
Attempt to circumvent SMS opt-out procedures
Use our platform to send unauthorized messages to others
Violation of these rules may result in immediate account termination.
8. TCPA Compliance and Legal Requirements
We comply with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and other applicable telecommunications regulations. We maintain records of all consent for SMS communications and honor opt-out requests immediately. By using our SMS services, you acknowledge that you have the authority to provide the mobile phone number and consent on behalf of the account holder.
9. Limitation of Liability
A. General Limitations
We provide services as-is without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability will not exceed the amount paid by you in the last three months of service.
B. SMS-Specific Limitations
We are not responsible for:
Failed message delivery due to carrier issues, device problems, or network outages
Charges incurred from your mobile carrier for SMS messages
Messages received after opting out due to carrier delays
Unauthorized access to messages on your device
You acknowledge that SMS is not a secure communication method and should not be used for sensitive information beyond appointment details.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan without regard to its conflict of law principles.
11. Changes to These Terms
We reserve the right to update these Terms at any time. Changes affecting SMS services will be communicated via email and/or SMS notification. Continued use of our services after changes are made constitutes acceptance of the revised Terms.
